D\u00e9finition<\/u><\/h2><p>Toute copropri\u00e9t\u00e9 a l\u2019obligation de mandater un syndic afin d\u2019assurer la gestion et l\u2019administration de la copropri\u00e9t\u00e9.<\/p><p><u><b>Il existe deux types de syndic :<\/b><\/u><\/p><ul><li><b>Le syndic professionnel :<\/b> Personne physique qui agit en son nom propre ou au nom d\u2019une soci\u00e9t\u00e9. Il est r\u00e9mun\u00e9r\u00e9 en contrepartie de la gestion de la copropri\u00e9t\u00e9. Pour exercer sa mission, le syndic professionnel doit :<ul><li>justifier d&rsquo;une garantie financi\u00e8re suffisante destin\u00e9e \u00e0 assurer \u00e0 la copropri\u00e9t\u00e9 le remboursement de ses fonds en cas de faillite<\/li><li>souscrire une assurance responsabilit\u00e9 civile professionnelle<\/li><li>poss\u00e9der une carte professionnelle de \u00ab\u00a0gestion immobili\u00e8re\u00a0\u00bb d\u00e9livr\u00e9e par la pr\u00e9fecture<\/li><li>ouvrir un compte bancaire ou postal s\u00e9par\u00e9 au nom de la copropri\u00e9t\u00e9 (sauf vote contraire de l&rsquo;assembl\u00e9e g\u00e9n\u00e9rale)<\/li><\/ul><\/li><li><b>Le syndic non professionnel :<\/b> Dans ce cas de figure, c\u2019est un copropri\u00e9taire qui s\u2019occupe de la gestion de la copropri\u00e9t\u00e9. Organisation<\/u><\/h2><p>Le syndic est mandat\u00e9 par l\u2019assembl\u00e9e g\u00e9n\u00e9rale des copropri\u00e9taires pour une dur\u00e9e de 1 \u00e0 3 ans renouvelable. Responsabilit\u00e9s<\/u><\/h2><p>Le syndic engage sa responsabilit\u00e9 civile en cas de faute dans l\u2019ex\u00e9cution de ses missions (faute dans la convocation et la gestion des assembl\u00e9es, actes pass\u00e9s sans autorisation, inex\u00e9cution des d\u00e9cisions de l\u2019assembl\u00e9e, carence relative au respect du r\u00e8glement de copropri\u00e9t\u00e9, faute dans l\u2019administration de l\u2019immeuble, d\u00e9faut de recouvrement des charges, faute dans la tenue des comptes, faute dans la conservation des archives, etc.).
